art. 28 of the T. U. grants the father a worker the right to refrain from working in the three months following the birth of the child in the event of death or serious infermità of the mother, abandonment of the son by the mother, sole custody to the father or rinucia expressed in the mother that has the right to paid leave for maternityà (rinucia possible only in the case of adoption or custody)

in order To avail himself of the leave paternità the father must submit to the employer:

    the

  • in the case of death of mother: death certificate or self-certification;
  • the

  • in the case of a serious infermità of the mother: the medical certification its, released by the NHS;
  • the

  • in case of abandonment: a self-certification pursuant to art. 47 of the Dpr 445/2000 (declaration in lieu of the deed of notorietyà);
  • the

  • in the case of sole custody (art. 150-bis, cod.civ.): documentation;
  • the

  • in the case of leave for maternityà on the part of the adoptive mother or who had the custody of the children: self-certification.
